> You have reached the I-360 team at the Nebraska Service Center . Please recall that your petition was received on November 24, 2009. On December 15, 2009 we issued you an email informing you of a major deficiency with your case. Please see the below section in red – this is what was sent to you on December 15, 2009.)
>
> Good morning Sir. I am an Immigration Services Officer at the Nebraska Service Center . I am currently reviewing the evidence submitted with the I-360 petition you filed on November 24, 2009.
>
> It is noted that the petition is marked “K” seeking SIV classification as an Iraqi National who worked with the U.S. Armed Forces as a translator. I have changed this classification to “L”, an Iraqi National who was employed by or on behalf of the U.S. Government (this includes translators). Please allow me to explain why this change was made.
>
> The classification you initially selected (the old translator program) has a very limited number of visas allocated for FY’09. Even an approved I-360 under this program does not provide a very good chance of providing a visa to the applicant. Also, a major requirement of this program is a letter of recommendation from a General in the U.S. Armed Forces. This petition does not contain this evidence, and consequently, you would have to obtain this letter in order for the petition to be approved.
>
> The program that I have changed the petition to reflect allocates 5,000 visas per year. An approved I-360 under this program gives a much greater chance of the applicant being issued a visa. While this program does not require a letter from a General, it does require an approval letter from the Chief of Mission. The petition does not contain this letter; however, I will provide instructions on how to obtain one.
>
> USCIS is granting an additional period of time for the missing required evidence to be submitted (the Chief of Mission approval letter). I am sending the “Notice of Intent to Deny” as an attachment in order to expedite the matter. Additionally, I am attaching the “SIV Guidelines” to assist with your response. Specifically, there was one deficiency that needs to be addressed:
>
>
> The petition does not contain a signed letter granting “Chief of Mission Approval for Iraqi Special Immigrant Visa Status” from the designee of the Chief of Mission (COM). The attached “Special Immigrant Visa (SIV) Application Guide” outlines the documentation you must submit to
IraqSIVapplication@state.gov to request the necessary COM approval.
>
> Please note this information was also mailed to the following address
.............................................................................................
>
> This email was sent as a courtesy copy to ensure that it was received.
>
> PLEASE INCLUDE “LIN1003751735 - NF” IN THE SUBJECT LINE OF ANY RESPONSE YOU SEND TO THIS REQUEST FOR EVIDENCE.
>
> Your response to the requested information must be received in this office by March 18, 2010. If you do not respond to this request within the time allowed, a decision will be based upon the record.
>
> After the form is completed, you may send the completed packet to either of the following addresses: USCIS/Nebraska Service Center, P. O. Box 87360 , Lincoln NE 68501-2521 or, for over night delivery services, to: USCIS/Nebraska Service Center, 850 "S" Street, Lincoln NE 68508 .
>
> In order for your I-360 to be approved, you must go through the process outlined above with the Department of State to obtain your Chief of Mission approval letter. Once you receive this letter, you can email me an electronic copy. In the meantime, please forward me any correspondence you receive from the Department of State relating to your Chief of Mission approval letter.
