يا ابناء شعبنا العراقي في كل مكان
يا سكان ما بين النهرين الأصلاء
تلاحمت الأفكار وشدت الايادي بقلوب صافية وعقول راجحة بعد ان التقت الارادات الحرة للنهوض بقلب واحد ورأي موحد وبصوت واحد نعلن لكم وامام العالم اجمع عن انطلاق عمل هيئتكم رسمياً تحت شعار
من اجل العدالة والمساواة لسكان ما بين النهرين الاصلاء
لن نسكت مادام شعبنا مضطهد
ويكون اسمها
الهيئة العالمية للدفاع عن حقوق سكان ما بين النهرين الاصليين
التي انبثقت بعد جهود سنين طويلة من الدراسات وبيان الآراء المتنوعة والمتعددة الى ان وصل الامر بنا كمجموعة من الغيارى ليس لهم سقف سوى سمو وشموخ سقف حقوق اهلهم سكان هذه البلاد الاصلاء، نعم نبت هذا الطود من بين الركام! من قلب الالم والموت والتهجير، من جور الاضطهاد المنظم، قديماً وحديثاً، جاءت هيئتنا لتعمل بشكل علني واضح وصريح كونها اول هيئة عالمية في العراق والوطن العربي تدافع عن الحقوق المسلوبة لسكان البلاد الاصليين بشكل قانوني! ضمن احترام القوانين الوطنية والقوانين الدولية وخاصة الصادرة عن الامم المتحدة ذات الصلة بحقوق السكان الاصليين، وعندما نؤكد على هذه الكلمة (الاصليين - " الاشوريون الكلدان السريان "الاراميون" والصابئة واليزيديون " ) ليس معنى ذلك تجزئة وتفرقة بين سكان الشعب الواحد ابدا، وانما نحن نعرف تاريخنا وحضارتنا وعاداتنا وتقاليدنا وديننا وقيمنا واخلاقنا! وباعتراف جميع مكونات شعبنا والعالم، هذه هي هويتنا حيث اننا شعب اصيل واحد عريق وجذورنا ممتدة في عمق التاريخ،عليه نكون قد قدمنا وصفاً لواقعنا كما هو ليس الا، وبهذا تكون هيئتكم نقطة التقاء وتقارب وجذب وحدة ابناء شعبنا، لذا ندعو احرار العالم لتقديم الدعم والحفاظ على هذا الوليد الجديد والمتجدد دائماً- بكل اشكاله/ المادي والمعنوي من اجل النهوض بمهامه ومهماته الكبرى التي سيضطلع بها والتي سيأخذها على عاتقه من اجل وضع البسمة والفرحة على شفاه كل من يحتاجها في هذا الوقت العصيب الذي يمر به شعبنا العراقي بشكل عام وشعبنا ما بين النهرين الاصيل بشكل خاص
نعم ايها الاخوة اننا لسنا ضد احد ولكن حتماً سيكون ويولد لنا اعداء الحقوق، وهذا شرف لنا جميعاً، لاننا وهبنا حياتنا قبل فكرنا وجهدنا ومالنا من اجل الاخر، لاننا نعلم ان دربنا ليس مفروشاً بالورود بل بالمسامير الطائفية والعنصرية والمذهبية والمصالح الخاصة والشخصية وسوف نكون هدفاً للمخططات الخفية للمؤسسات الداخلية والخارجية وذات المصالح الفردية والخاصة، ولكن قررنا المضي في طريق الالام والتضحيات الى ان نرى مع اجيالنا اننا حققنا ما كنا نصبو اليه في اعادة حقوقنا المسلوبة في كل زمان ومكان! عليه كانت البشرى في عيد ميلاد رب السلام بولادة طبيعية لهيئتكم النبيلة التي لا يهدأ لها بال ولا تسكت مادام هناك ظلم واضطهاد يقع على شعبنا من سكان ما بين النهرين الاصلاء! انها منظمة من منظمات المجتمع المدني! ومن هيئات حقوق الانسان الخاصة، غير سياسية وغير دينية، تدافع عن الحق والحقوق بطرق قانونية، غير ربحية وغير نفعية،حيث تمثل نخبة مثقفة من المتطوعين الغيارى على مصير شعبهم، فيها المحامي والطالب والمهندس والاستاذ الجامعي والدكاترة وخبراء واستشاريين وكتاب ومثقفين واكاديميين ورجال اعمال من مختلف شرائح المجتمع، عليه تعلن هيئتنا عن مد يدها بكل روح وانسانية وحقوقية بقلب صاف الى جميع الهيئات والمنظمات والبرلمانات من اجل التعاون وتقديم الخبرة والمشورة لانتشال شعبنا وسكان ما بين النهرين من الضياع، لان الامر وصل الى حد تهديد كيانه ووجوده وهويته، عليه انبثقت هيئتكم لتنبري وتدافع عن الحق وحقوق شعبنا المهدورة، من خلال نكران الذات والتضحية في كل شيئ من اجل خير شعبنا واعادة كرامته المهدورة، ويكون الهدف ايضاً هو رفعة الشأن العراقي كدولة تكون مصداقيتها في تحقيق حقوق (ما يسمى بالاقليات) من دون تمييز طائفي/عرقي/ديني/قومي، نعم انه تساوي كافة المواطنين في الحقوق والواجبات وتطبيق قرارات الامم المتحدة بهذا الشأن، انها العدالة والمساواة لجميع بني البشر وتساوي كرامة الشخص البشري، وبهذا وضعت هيئتكم حقوق شعبها على السكة الصحيحة انها حقوق سكان البلاد الاصليين تناديكم ايها الاحبة

نظرا لما عاناه ويعانيه سكان ما بين النهرين الاصلاء وخاصة في العقد الاخير من الزمن من قتل وتهجير واضطهاد منظم مما ادى و سيؤدي حتماً الى طمس حقوقهم وزوال وجودهم وكيانهم وهويتهم ان استمر الوضع على ما هو عليه اليوم، لذا قررت مجموعة من الغيارى الى تشكيل هيئة حقوقية واستشارية لتقديم خدماتها من اجل الدفاع عن حقوق شعبنا واهلنا والحفاظ على كرامته التي بات يفقدها يوماً بعد يوم نتيجة سياسات المحاصصة الطائفية العنصرية والمذهبية المقيتة، ونحارب الباطل من اجل الحق! وخاصة الارهاب الفكري والثقافي والديني والاجتماعي عن طريق ممارسة ثقافة الحوار والدفاع عن حقوقنا سلمياً وقانونياً، ان هيئتنا هي منظمة من منظمات المجتمع المدني – حقوق الانسان – طوعية غير نفعية، تدافع قانوناً امام المحاكم العراقية والعربية والدولية عن حقوق سكان ما بين النهرين الاصليين كأشخاص وكمجموعات، بحيث يرفع الغبن والقهر منهم ووضع البسمة والفرحة على شفاههم! عندما يرجع الحق لاصحابه ويعم الخير للجميع ويكون هناك امان وطمأنينة وبذلك نساهم في استقرار العراق الحر الديمقراطي التعددي، عراق القانون والمؤسسات كواقع عملي وملموس

يتكون شعار الهيئة من خارطة العراق مع جريان النهرين (دجلة والفرات) وعند التقائهما هناك يد حاضنة (الهيئة) ترفع شعار"العدالة والمساواة" وخلفهما ميزان يرمز الى تحقيق شعارالهيئة (العدالة والمساواة) ومن الجانب الايمن شروق الشمس الذي يرمز الى ولادة الهيئة ومن الجانب الايسر القمر غير مكتمل الذي يرمز الى ان الحقوق مسلوبة

المادة الثالثة
الاهداف
اولا- الدفاع عن حقوق سكان ما بين النهرين المسلوبة، عن طريق القانون والمحاكم الوطنية والعربية والدولية
ولغرض تحقيق هذا الهدف تتشكل الهيئة من
آ- هيئة الرئاسة: (الرئيس – الامين العام – النائب القانوني – النائب المالي – النائب الاداري - النائب الاعلامي)
ب – هيئة حقوقية
1. تتولى البحث في المظالم التي تعرض لها شعبنا بشكل منظم على مر التاريخ لتثبيت حقوقنا الانية والمستقبلية اضافة الى الدفاع عن القضايا المطروحة والساخنة على الساحة الداخلية والخارجية ومهما كانت الجهة المُضْطَهِدة "الظالمة" التي تقوم باضطهاد ابناء شعبنا مهددة هويته وكيانه ووجوده
2. اعادة كرامة شعبنا المضطهد حقوقيا وثقافيا وامنياً ودينياً
3. الدفاع عن أي قضية لها علاقة باضطهاد شعبنا. فردياً وجماعياً
4. المطالبة بتعديل الدستور وضمان حقوق سكان الاصليين (وتبديل كلمة الاقليات) بكلمة السكان الاصليين اينما وجدت
5. العمل على ان يكون احد نواب رئيس الجمهورية العراقية ونائب رئيس اقليم كردستان من السكان الاصليين للبلاد
6. تمثيل شعبنا في الانتخابات البرلمانية
على ان يكون العدد من 10 – 15 عضو برلمان كونهم من السكان الاصليين ولهم وضع وقانون خاص اسوة بباق الدول الديمقراطية
7. الحفاظ على عادات وتقاليد وتراث وطقوس السكان الاصليين وينظم ذلك بقانون بعد تثبيته في الدستور
8. حق نقض اي قرار او قانون لا يتعارض من الضد لحقوق السكان الاصليين
ثانياً- اتباع الطرق القانونية في حل جميع القضايا المطروحة مع احترام القوانين المحلية التي تتماشى مع حقوق الانسان والدولية المرعية
ثالثاً: تشكيل هيئات مرتبطة بالهيئة الرئاسية لتسهيل عمل الهيئة
1- هيئة الانضباط
2- هيئة الاعلام
3- الهيئة المالية
رابعاً- لجنتين حقوقيتين مكونة من محامين دوليين (داخلية وخارجية) باشراف مكتب محامي استشاري (دولي )عالمي
خامساً- أستحصال الموافقات الرسمية لعمل الهيئة من الجهات المعنية سواء داخل العراق او خارجه
سادساً- تكون قرارات هيئة الرئاسة ملزمة في جميع الحالات ويكون المؤتمر اعلى سلطة للهيئة
سابعاً- لغرض الوصول الى نتائج عملية ملموسة لاهداف هيئتنا يكون هناك تعاون مع الحكومة المركزية/بغداد وحكومة اقليم كردستان من خلال احترام للقوانين الوطنية والتزام وتطبيق القوانين الدولية المرعية وحسب قانون كل دولة، وخاصة الاعلانات والقوانين الصادرة عن الامم المتحدة ومجلس الامن الدولي الخاصة بحقوق الانسان وبسكان البلاد الاصليين، وتعاوننا التام مع منظمات المجتمع المدني وحقوق الانسان والمنظمات الحقوقية المحلية والدولية، مع تثبيت حقنا في الدفاع عن حقوق شعبنا اينما وجد، كأشخاص او مكونات او منظمات او حكومات ومحاربة كل اشكال الارهاب وبكل انواعه ( العسكري و فكري و ديني و سياسي و الثقافي و التربوي و الاجتماعي والحقوقي ايضاً)
المادة الرابعة
فروع الهيئة القانونية
تتفرع الهيئة الحقوقية الى
1- هيئة حقوقية عالمية تتولى الدفاع عن سكان ما بين النهرين الاصليين في الخارج وخاصة في اروقة الامم المتحدة والاتحاد الاوربي وامريكا واستراليا
2 – هيئة حقوقية محلية (داخل العراق) تتولى الدفاع عن حقوق سكان ما بين النهرين الاصليين امام القضاء والمحاكم العراقية
3- يتم التعاون التام بين الهيئتين خدمة لمصلحة شعبنا
4 – هيئة استشارية مهمتها تقديم الخبرة اللازمة للهيئة الحقوقية في كافة المجالات لتسهيل مهمتها
المادة الخامسة
المالية
بما ان منظمتنا طوعية وغير نفعية
1- لا توجد اشتراكات انتساب( الا اذا حدد بقرار من هيئة الرئاسة او من المؤتمر ) سوى دولار واحد شهرياً او ما يعادله
2- يكون التمويل ذاتي طوعي وحسب الامكانية
3- تقبل التبرعات من برلمانات الدول
4- تقبل التبرعات والهبات من الشخصيات والمنظمات الخيرية والمنظمات الخاصة والمستقلة والمؤسسات ذات العلاقة والعامة التابعة للامم المتحدة والغير مشروطة
5- - يتم فتح حساب صندوق خاص لهذا الغرض، وان تطلب الامر في كل فرع وهيئة ويكون لها كل الصلاحيات ادارياً ومالياً ما دام هناك مصلحة الوطن والشعب
6- يتم استلام التبرعات من قبل لجان تشكل لهذا الغرض مقابل وصل استلام رسمي
المادة السادسة
شروط العضوية
العضوية
1- كل راغب في التطوع من اجل الدفاع عن شعبه
2- ان لا يقل عمره عن 21 سنة
3- مؤمن بالتنوع والتعدد وقبول الاخر وتساوي كرامة الجنس البشري مع ايمانه باننا شعب واحد
4- يؤمن بان سقف ومصلحة الشعب والوطن وبموجب الحقوق الاساسية المتضمنة في المواثيق الانسانية والدولية وكما مدون في مواثيق الامم المتحدة المختصة اعلى من اي سقف ومصلحة اخرى حزبية ومذهبية وطائفية (دينية وسياسية واجتماعية وثقافية)
المادة السابعة
فقدان العضوية
1- يعتبر العضو صديقاً للهيئة وتزول عضويته الاعتبارية في حالة
آ- عدم رغبته بالعمل التطوعي ويقدم طلبا خطياً ان كان عضو الهيئة المؤسسة، ويعتبر مستقيل بعد مرور اسبوع واحد من تقديم الطلب
ب- عندما يحال العضو الى لجنة انضباط خاصة في حالة خروجه عن اهداف الهيئة او كشفه اسرارها الى جهات داخلية وخارجية التي تقف من الضد لحقوق سكان البلاد الاصليين او عدم التزامه بالنظام الداخلي
ج- يُقدم العضو في آ الى لجنة الانضباط بعد طلب اثنين من اعضاء مجلس الرئاسة او عضوين من المجلس الحقوقي العام للهيئة وله الحق التام للدفاع عن موقفه ويرفع القرار الى هيئة الرئاسة للموافقة عليه ويكون قرارها باتاً
د- في حالة هناك خلاف مع احدى الهيئات العاملة في انحاء العالم يحل الاشكال عن طريق عقد مؤتمر استثنائي وبالحوار الديمقراطي، وفي حالة عدم التوصل الى اتفاق تتخذ الاجراءات المناسبة بحق الهيئة الفرعية كشخصية معنوية وكمجموعة ان تطلب الامر، وتحافظ هيئتنا على اسمها "الهيئة العالمية للدفاع عن سكان ما بين النهرين الاصليين" تحت اي ظرف كان
المادة الثامنة
ديمقراطية الهيئة الرئاسية
1- يُعقَد مؤتمر للهيئة بعد مرور سنة واحدة من الاعلان الرسمي لها في 25/12/2009
2- يكون هناك مؤتمر عام كل اربع سنوات، يتخللها مؤتمر سنوي خاص بالهيئة المؤسسة واللجنة الحقوقية لتدارس المستجدات وتقييم الخطتين السنوية والخمسية كما في (1)
2- لرئاسة الهيئة الحق في طلب عقد مؤتمر استثنائي لبحث المستجدات الطارئة
3- يتم في المؤتمر العام انتخابات حرة وديمقراطية لتوزيع المهام وتجديد هيئة الرئاسة، ويكون وجوباً بحضور ثلاث محامين وقاضي وان تعذر محامي واحد وقاضي فقط يشرفون على الانتخابات بمحضر رسمي
3- يكون المؤتمر قانوناً بعد حضور 50% + 1 من اعضاء الهيئة المؤسسة واعضاء اللجنة الحقوقية والمندوبين
5- تتجدد اعمال هيئة الرئاسة كل اربع سنوات، مع انعقاد المؤتمر العام
