هناك شخص متواجد على الفيس بوك وعلى صفحة جماعة الاس اي في SIV الافغانييــــــــن وهو مسؤول الصفحه
وقد عمل صفحه خاصــــــــــــــــــــــــــــــــــــــــــة للعراقييــــــــن ايضا ..!!!
وهو عسكري امريكي وأسمه "   Ronald Payne  "خدم بافغانستان ويعمل في مجال الصحه والتمريض للجنود وهو يساعد الافغانييـــــن والعراقييــــــن وكل من يريد المساعده في قضاياهم من جماعة  IOM و SIV واكثر اهتمامه للي مقدمين على برنامج ال SIV وهو يكتب معلومات كثيره ومفيده في مواضيع عده ويجاوب على اي سؤال مطلوب

Salam Iraqi SIV's and SIV Applicants. I would like to take this time to introduce myself to you and to say what I hope to accomplish on this webpage. My name is Ronald Payne and I am a Special Consultant and Subject Matter Expert as it pertains to the Special Immigrant Visa Program and the Immigration and Resettlement of Foriegn Nationals who have United States Government, Coalition Forces, and/or International Government Organization and/or Non-Governmental Organization Affiliations in support of the Global War on Terrorism and/or the Overseas Contingency Operations.

My Credentials include but are not limited to (1) In my Military Capacity I am a Staff Sergeant in the United States Army where I serve as a Nurse and as a Special Consultant and Subject Matter Expert in support of the Special Immigrant Visa Program for Iraqi and Afghan Linguists and Cultural Advisors. In this capacity my "Client" is the United States Government, (2) In my Civilian Capacity (Off-Duty from the Military) I am the Director of Special Projects with the God of Abraham Ministries and Charities (which is a combined Muslim-Christian-Jewish Religious and Humanitarian Assistance Organization) and the Founder and Leader of its Auxillery Organization, the Allied Freedom Project (which is a NGO that has the mission to assist Foriegn Nationals who were employed by, on behalf of, or otherwise assisted, the United States Government, a Coalition Force, or an International Governmental or Non-Governmental Organization in support of the Global War on Terrorism and/or the Overseas Contingency Operations. In that capacity my Client is "YOU", (3) I have been involved in the SIV Program in both my military and civilian capacities since early 2007, and I have been involved to a greater or lesser degree in about 3500 SIV and SIV Application Cases, Special Refugees with USG Affiliation Cases (IOM), and Traditional Refugee and Asylum Cases where the Asylum Applicant was an Iraqi or Afghan LCA, and (4) In both of my capacities I also frequently provide Special Consultant and Subject Matter Expertise to Federal, State, and Local Government Officials and Community Leaders as it pertains to the SIV Program and the Immigration and Resettlement of Foriegn National Linguists and Cultural Advisors and other Foriegn Nationals with United States Government, Coalition Force, and/or IGO/NGO Affiliations that furthered the National Security Interests of the United States Government. Likewise, about once or twice a year I am requested to serve as an Expert Witness and/or Subject Matter Expert in the United States Immigration Court (usually Asylum Cases) where I typically provide testimony as to the threats that LCA's are subjected to as a result of their service in support of the USG, a Coalition Force, and/or an IGO/NGO's operating in Iraq and Afghanistan, and the likeihood that the LCA would be tortured and/or killed if captured by Enemy Forces and/or Criminal Elements in Iraq or Afghanistan... In short, for the past 7 years I have been involved in just about every aspect of the SIV Program from the initial SIV Application to becoming a United States Citizen and everything in-between...

In addition to my SIV Activities with the USG and the Allied Freedom Project (which I have to stress are two completely separate and distinct entities, and nothing stated herein should be construed to be an endorsement in support of one or the other) and my affiliation as an Assistant Administrator on this Webpage, I am also an Assistant Administrator on the Afghan SIV Applicants Association Webpage.

My "activities" involve all aspects of the Immigration and Resettlement Process, and for time allocation, 1/3 of my time is dedicated to the Immigration Phase, and the other 2/3 of my time is dedicated to the Resettlement Phase. After 7 years of doing SIV, Refugee, and Asylum work, I have seen what has worked and how things can go terribly wrong. The key to learning these lessons is to replicate what has gone well and to avoid what has gone wrong...

In this regard, there is many things that I am going to say, and while much of what I'm going to say, you will not understand at first, every lesson that I teach will build upon the last class, and trust me when I say that everything that I say or teach has a reason and a purpose. A person must learn to crawl before they can walk, and to walk before they can run...

Second, I will be absolutely honest with you, brutially honest in American Terms, even to the point where you may think I am being rude or mean, but I am not trying to insult or offend you, I am trying to help you, and sometimes providingthat help requires a sharp tongue and a heavy hand... there is an old Iraqi saying that goes "your true friend will make you cry"... Once again, I'm dedicated to this endevor, and it is my intention to help you by way of teaching, coaching, and mentoring, and if the price of your success costs a hurt feeling or a bruised ego, so be it, that is the price that YOU will have to pay if you want the knowledge that I am willing to give you for free. The only thing that I expect in return is what any Teacher should reasonably expect from their Students, and that is to be polite and respectful... I also expect that any knowledge that I give you, that you will in turn will use that knowledge to not only help yourself, but that you will also use that knowedge to help your fellow Iraqi SIV's and SIV Applicants.

Additionally, this Webpage was created by an Iraqi SIV Applicant, I am only an Assistant Administrator and a Guest Teacher, Coach, and Mentor. This is YOUR Webpage and YOUR SIV and SIV Applicant Community. Furthermore, while I am more than willing to provide as much assistance as I can to you, please keep this in mind, my time is very limited and I'm trying to use what little time that I have to provide as much help I can to as many people as I can, and almost 90% of your questions can be answered and your requests for assistance can be satisfied if you only follow the Posts that I will be Posting over the next 30 to 90 days. Likewise, except in the most extraordinary cases, my response time to answer a personal email is averaging about one to two weeks, and requests to prepare and/or review any SIV Applications or other Immigration/Resettlement Documents and/or Forms is averaging one to three months. However, I will answer any Questions Posted on the webpage within a few dayst most, I only request that any questions openly posted do NOT contain any Personally Identifiable Information (ie. Do NOT state your real name, an exact location, stuff like that), USG Secrets or Sensitive Information, or anything else that could be used by the Bad People...

Finally, The SIV Process is a very long process to go through, so you might as well use whatever time you have to prepare for your eventual immigration to and resettlement in the USA... And in conclusion for this Introductory Post, the Iraqi and Afghan LCA's have much in common and you both can learn from and support each other. In San Antonio Texas where there is the largest organized group of SIV's, there are several Iraqi and Afghan SIV's who are living together and saving lots of money on their living expenses because of it and many of them have become very close friends. Think about it, you both worked for the same employer, the USG (US Military), you both were in a war, you both have the same SIV Visa and gone through the same SIV Visa Process, and most importantly, you both speak English... PS: I speak much better pashto than I do Arabic. I only know a few words and phrases in Arabic but I'm doing the best I can to learn a word and phrase here and there. الصراحة من صيغة الاجابه فالظاهر انها ايجابيه وتصب في مصلحتكم اذا اردتم التقديم
وصراحة الرجل قد تعامل بعدد هائل من الكيسات ومثلما جاء في رسالته المعنونه للاخوه العراقيين والملحقه في البند الثالث ادناه ( 3500 كيس ) وعلى الرساله التي وجهها حديثا بسبب عمله الصفحه الخاصه للعراقيين بعد ان كان قد اتمم صفحة الافغانيين او الذين عملوا مع الجيش الامريكي في افغانستان ولديه الخبره ثم انت مراح تخسر شيء والقرار لكم انتم اولا واخرا

There has been several requests to make this a Closed Group, and it seems that it has opened and closed again several times. I really could care less either way, but I know that several members are concerned about their safety (ie. being identified by the bad people, and that is a very legitimate concern). but lets be realistic, unless we required everyone to show proof of their USG Affiliation to join the Group, which just is NOT going to happen for every reason under the sun, there is just no practical way for us to determine who, and who is not, who they say they are. It is up to the Chief Administrator to make this an Open or Closed Group, but for Security Purposes, this would be my recommendations that everyone should follow, irrespective if this is an open or closed group:

1. Do NOT post anything that involves any kind of secret or sensitive information, be it about the USG, Coalition Forces, or even the Iraqi Government.

2. Do NOT post any pictures that show you or anyone else in a military uniform, or posing with USG or Coalition Personnel.

3. Unless you really don't care about using your personal facebook account, I would highly suggest that you have two facebook accounts. One that you use for all your "PUBLIC" activities (ie. this webpage), and another facebook account to do all of your "PRIVATE" activities (family and friends). On your PUBLIC facebook account, all of your information, picture, name, location, and stuff like that should be FAKE. Likewise, if you are going to use your Real Facebook Account, then you should make sure there is nothing in your Real Profile that could be used by the bad people to hurt your, your family, or any other Interpreter/Translator.

So in conclusion, whether this is an open or closed group, it is ultimately your responsibility to manage YOUR Security, and one way to protect your security is to have two facebook accounts, one that you use with your family and friends, and the other you use in a public setting, where it is completely fake and it would not matter if the bad people saw it.

now as a side note, I don't need any of your personal information to give advice or guidance, but if you want me to prepare or review any information or documents, I will require proof of USG Affiliation, and that will be done off site, in a private setting, where you can also positively identify me (trust goes both ways)... Once again, if you assume that the Bad People are with and among us, and you take the appropriate security measures, we should all be safe and secure...

هذا جواب الرجل العسكري رونالد بين بشان هذا الموضوع ولكنه يركز على موضوع استلام الزوجه للفيزا قبل الزوج وفيها ملاحظات مفيده انقلها لكم للفائده العامه وجاء فيها :-

I've seen lots of cases where the Spouse was issued their Visa and the Primary Applicant was still undergoing AAP. in these cases I am advising that the Spouse be IMMEDIATELY transported to the USA. The reason for this is that if the Spouse is in Iraq/Afghanistan and the Primary Applicant COM-LOR is revoked and the Spouse is still in Iraq/Afghanstan, then they will also revoke the Spouse Visa. But if the Spouse travels to the USA and is admitted at the Port of Entry, then it is too late to revoke the Visa and the State Department loses jurisdiction over the case to the United States Citizenship and Immigration Service and the Spouse gets to stay in the USA. Now the impoartance of that is because a "Green Card" Holder, of which is what the SIV
Visa is, can then "Sponsor" their Spouse via a USCIS Form I-130... Likewise, even if after being admitted into the USA at the Port of Entry, they wanted to deny entry or begin removal proceeding, the "Spouse" could then claim "Asylum" and it would only be a matter of time until Asylum was granted and the "Spouse" could then "Sponsor" what would otherwise be the "Primary Applicant"... Likewise, once a person has been admitted into the United States as a Permanent Resident Alien (the proper term for a Green Card holder, and by the way, "Green Card" is just a slang term for the ID Card because for over 50 years it used to be "Green", but now it is whole with a hologram background, but everyone, even the government, still calls it a "Green Card") they are eligible to travel on their Green Card, or as I highly recommend, on a US Travel Document which is also a "Re-Entry Permit" good for up to 2 years...

صراحة الرجل مشتغل على مايعادل من 3500 قضيه من افغان وعراقيين وهو امريكي ويريد يساعدك وهو اعرف باللي طلبه منك وهو يسال عن درايه ويريد يناصرك بقضيتك - والله اعلم - وهذا رايي المتواضع طبعا والقرار لكم انتم اخي رجاء واذا تحس انه لاتريد ان تعمل ذلك فهذا من حقك والله ييسر امورك

الظاهر ان الرجل العسكري استلم رسائل عديده جدا وفيها طلبات او اساله هي اصلا موجود الاجابه عليها

فلقد بلغ مجموع المعلومات التي كتبها مايعادل 100  ( مئة صفحه ) من المعلومات وكميه كثيره من الامور الحياتيه لاميركا وكذلك فيها اساله واجوبه عديده لاناس لديهم اساله مشابهه لما يدور في بال معظم السائلين ونظرا لانشغاله الكبير في القضايا المهمه والتي فعلا تحتاج الدراسه والاسراع بتقديم يد العون لصاحب الكيس قبل انتها المده 30 سبتمبر - لذا فهو يطلب راجيا من ضرورة الاطلاع على المعلومات المنشوره على الفيس بوك وربما وضع بصمة القارئين والاعضاء ( من اختيار كلمة Like ) لكي يعزز من شان الصفحة واهميتها عالميا لتحصل على الصدى الاعلامي المطلوب ويكون شانها شان صفحة الاخوه الافغانيين والتي وصل صداها لاعلى المستويات والتي على ضوئها استطاع السيد رونالد من عمل مقابلاته الصحفيه والاعلاميه والالتقاء باعضاء من الكونجرس الاميركي للنظر بقضية العراقيين والافغان الذين عملوا مع الجيش الاميركي

To provide special recognition to and reasonable accommodations for the protection of foreign nationals with United States Government Affiliations, and for other purposes.

Be it enacted by the Senate and House of Representative of the United States of America in Congress assembled,

SECTION 1

SHORT TITLE

This Act may be cited as the “American Allies Special Recognition and Protection Act for Foreign Nationals with United States Government Affiliations”.

SECTION 2

CONGRESSIONAL FINDINGS, DECLARATIONS, AND LEGISLATIVE INTENT

1. Congress hereby finds and declares that the national security and other interests of the United States Government is supported by foreign nationals who are or were employed by, on behalf of, or otherwise assisted the United States Government.

2. Congress hereby finds and declares that the United States Government should confer special recognition upon those foreign nationals for whom their service with and/or assistance to the United States Government was honorable, faithful, meritorious, and valuable, and/or their service with and/or assistance to the United States Government otherwise provided a significant contribution to the national security or other interests of the United States Government.

3. Congress hereby finds and declares that the United States Government has an obligation to provide reasonable protection to those foreign nationals who has experienced or is reasonably expected to experience a threat of harm against their person or property, or otherwise has a credible fear retribution or persecution, resulting as a consequence of their service with and/or assistance to the United States Government.

4. Wherefore, it is the Intent of Congress that it shall be the National Policy of the United States Government to provide Foreign Nationals with United States Government Affiliations with whom their service with and/or their assistance to the United States Government was honorable, faithful, meritorious, and valuable, and/or their service with and/or assistance to the United States Government otherwise provided a significant contribution to the national security or other interests of the United States Government, or who has experienced or is reasonably expected to experience a threat of harm against their person or property, or otherwise has a credible fear retribution or persecution, resulting as a consequence of their service with and/or assistance to the United States Government, with a comprehensive scheme of programs that provide realistic opportunities for summary citizenship, expedited citizenship, preferential immigration, resettlement benefits, and reasonable accommodations for the protection of such Foreign Nationals with United States Government Affiliations and their Family Members.

SECTION 3

LEGISLATIVE DEFINITIONS

1. A Foreign National with United States Government Affiliations shall consist of any person who is other than a United States Citizen or National thereof, and who is or was employed by or on behalf of the United States Government and/or otherwise assisted the United States Government.

2. Service by or on behalf of, or service to, the United States Government shall consist of any employment relationship, with or without monetary compensation, from which the United States Government received any tangible benefits from such foreign national as a result of such employment relationship thereof.

3. Assistance to the United States Government shall consist of any continuing or single act of aid, service, or support, from which the United States Government received any comparative benefit as a result of such aid, service, or support thereof.

4. Contribution to the National Security or other National Interests of the United States Government shall consist of any sustained or singular act of service with and/or assistance to the United States Government that furthered the National Security or Other Interests of the United States Government.

SECTION 4

CREATION AND ADMINISTRATION OF SPECIAL CITIZENSHIP, IMMIGRATION, RESETTLEMENT AND PROTECTION PROGRAM FOR FOREIGN NATIONALS WITH UNITED STATES GOVERNMENT AFFILIATIONS

1. The Secretary of Homeland Security, by and through the Director of the United States Citizenship and Immigration Service, and the United States Secretary of State, by and through the various Chief of Mission, shall jointly create and administer a comprehensive program providing for summary citizenship, expedited citizenship, preferential immigration, resettlement benefits, and reasonable accommodations for the protection of Foreign Nationals with United States Government Affiliations and their Family Members. In furtherance of this provision -

(A) The Secretary of Homeland Security, by and through Director of the United States Citizenship and Immigration Service, is hereby designated as the Central Authority to administer such special programs, and shall be vested with overall responsibility for the effective and efficient management of such special programs herein.

(B) The United States Secretary of State, by and through the several Chief of Mission thereof, shall be responsible for the effective and efficient issuance of travel documents and/or visa’s to such Foreign Nationals with United States Government Affiliations, who may from time to time be conferred with such recognition, status, and benefits by the Director of the United States Citizenship and Immigration Service made pursuant to the applicable provisions of this Act.

(C) The Secretary of Homeland Security and the Secretary of State shall collaborate and establish such Joint Regulations, Policies, and Procedures, to effectively and efficiently process such Petitions for Recognition, Status, or Benefits made pursuant to the applicable provisions of this Act, and in so establishing and implementing the same –

(1) The Secretary of Homeland Security shall –

(a) Make provisions for the submission of petitions for recognition, status, or benefits made pursuant to the applicable provisions of this act, in such manner including, but not limited to (1) in-person, postal, or electronic delivery to a centralized location, (2) in-person or postal delivery within the United States to any USCIS Service Center, and (3) in-person or postal delivery to any United States Embassy or Consulate that may be found abroad.

(b) Establish and Implement a centralized system for the submission, adjudication, and administrative review of such petitions for recognition, status, or benefits made pursuant to the applicable provisions of this act. In this regard, such centralized system shall except in the case of a summary approval, provide for a notice and a hearing prior to rendering any adverse decision thereof and such hearing thereof may be conducted by video-teleconference or any other electronic means.

(c) Establish and Implement a system to provide any Foreign National who has petitioned for any recognition, status, or benefits made pursuant to the applicable provisions of this act, and with whom such petition thereof was denied, written notice of the reason and an explanation of the particulars in rendering such decision thereof, and statement of availability and instructions to request an administrative appeal thereof.

(d) Establish and Implement a system to provide any Foreign National who has been aggrieved by an adverse decision upon any petition for any recognition, status, or benefits made pursuant to the applicable provisions of this act, with an administrative review of such adverse decision thereof. In this regard, the Foreign National shall be afforded not less than 90 days to submit a request for administrative review under this provision, and such administrative review shall be completed within 90 days of submission thereof.

(2) The Secretary of State shall –

(a) Establish and Implement a centralized system for the submission, adjudication, and administrative review of such requests for travel documents and/or visa’s that are collateral to the recognition, status, and benefits made pursuant to the applicable provisions of this act. In this regard, such centralized system shall except in the case of a summary approval, provide for a notice and a hearing prior to rendering any adverse decision thereof and such hearing thereof may be conducted by video-teleconference or any other electronic means.

(b) Establish and Implement a system to provide any Foreign National who has applied for any travel documents and/or visa’s that is collateral to any recognition, status, or benefits made pursuant to the applicable provisions of this act, and with whom such application thereof was denied, written notice of the reason and an explanation of the particulars in rendering such decision thereof, and statement of availability and instructions to request an administrative appeal thereof.

(c) Establish and Implement a system to provide any Foreign National who has been aggrieved by an adverse decision upon any application for any travel documents and/or visa’s that is collateral to any recognition, status, or benefits made pursuant to the applicable provisions of this act, with an administrative review of such adverse decision thereof. In this regard, the Foreign National shall be afforded not less than 90 days to submit a request for administrative review under this provision, and such administrative review shall be completed within 90 days of submission thereof.

2. Any Foreign National with United States Government Affiliations who has Petitioned for any Recognition, Status, or Benefits made available pursuant to the applicable provisions of this Act, and whom is aggrieved by any decision to deny or withhold such Recognition, Status, or Benefits thereof, may after exhausting any administrative review as may be provided for in this Act, have such matter reviewed –

(A) In the United States Immigration Court in the District in which the Foreign National has designated for Resettlement, or in which the Foreign National may be found, or if such Immigration Court cannot be readily ascertained, then in such Immigration Court as may be designated by the Director of the United States Citizenship and Immigration Service, of which such Court therein shall be empowered to hear such matter and issue appropriate orders therein. The Director of the United States Citizenship and Immigration Service and the Immigration Court thereof shall make reasonable accommodations for the Petitioner if otherwise incapable of making a personal appearance, to appear therein via video-teleconference or any other electronic means.

(B) In the United States Board of Immigration Appeals, of which such Board thereof shall be empowered to review the decision of the Immigration Court and to issue appropriate orders therein. Thereafter, the Foreign National thereof may seek judicial review as otherwise provided by Law or Regulation.

SECTION 5

SPECIAL CITIZENSHIP PROGRAM FOR FOREIGN NATIONALS WITH UNITED STATES GOVERNMENT AFFILIATIONS

1. Notwithstanding any other provision of law, the Director of the United States Citizenship and Immigration Service shall summarily confer United States Citizenship upon –

(A) Any Foreign National with United States Government Affiliations who has been Nominated for United States Citizenship by –

(1) The President of the United States of America; or

(2) By a Joint Resolution of Congress, and;

(3) Such Nomination or Resolution thereof was predicated upon such foreign national’s service with and/or assistance to the United States Government, and such service with and/or assistance to the United States Government was particularly honorable, faithful, meritorious, and valuable, or any descriptors similar thereto, or where such service with and/or assistance to the United States Government otherwise amounted to an extraordinary contribution to the National Security or other National Interests of the United States Government.

(B) Any Foreign National with United States Government Affiliations who was killed in the line of duty, or who’s death otherwise resulted as a consequence of that persons service with and/or assistance to the United States Government, provided –

(1) The Director of the United States Citizenship and Immigration Service has been satisfied after a reasonable inquiry, that the Foreign National with United States Government Affiliations thereof, was killed in the line of duty, or who’s death otherwise resulted as a consequence of that persons service with and/or assistance to the United States Government; and

(2) Conferral of such United States Citizenship thereof would not be contrary to the best interests of the United States Government.

SECTION 6

SPECIAL IMMIGRANT PROGRAM FOR FOREIGN NATIONALS WITH UNITED STATES GOVERNMENT AFFILIATIONS

1. Notwithstanding any other provision of law, the Director of the United States Citizenship and Immigration Service may confer the Status of a Special Immigrant upon any Foreign National with United States Government Affiliations, provided -

(A) Such Foreign National has been nominated or otherwise awarded a favorable recommendation for the conferral of such status by –

(1) The President of the United States of America, the Head of any Executive Department or Agency of the United States Government or their designee thereof, or any official from such Executive Department or Agency that occupies any position or status greater than or equal to a General Officer of the Military Services or a Member of the Civilian Senior Executive Service, provided that such military or civilian official thereof is in the direct military chain of command, or is in the direct line of civilian supervisory responsibility, from which the foreign national was employed by, on behalf of, or otherwise provided assistance thereto, or any Member of the United States Senate or the House of Representatives.

(B) Such Foreign National’s service with and/or assistance to the United States Government having been characterized as being remarkably honorable, faithful, meritorious, and valuable, or any descriptors similar thereto, and/or such service with and/or assistance to the United States Government otherwise amounted to a significant contribution to the National Security or other National Interests of the United States Government.

(C) Such Foreign National has undergone a favorable background investigation to the satisfaction of the Director of the United States Citizenship and Immigration Service, and;

(1) Has been found to be admissible to the United States as a Permanent Resident Alien, excluding the grounds for inadmissibility specified in Section 212(a)(4) of the Immigration and Nationality Act, or has obtained a waiver of such inadmissibility from the Director of the United States Citizenship and Immigration Service, and is eligible to receive an immigration visa, or has obtained a waiver of such ineligibility from the United States Secretary of State, and;

(2) The conferral of the Status of a Special Immigrant with United States Government Affiliations thereof would not otherwise be contrary to the best interests of the United States Government.

2. Any Foreign National with United States Government Affiliations that has been conferred with the Status of a Special Immigrant by the Director of the United States Citizenship and Immigration Service shall be admitted into the United States as a Permanent Resident Alien, or if already within the United States, such current status shall be adjusted as appropriate, and shall be eligible for Constructive Credit for Residency towards United States Citizenship.

SECTION 7

SPECIAL ASYLUM AND REFUGEE PROGRAM FOR FOREIGN NATIONALS WITH UNITED STATES GOVERNMENT AFFILIATIONS

1. Any Foreign National may be recognized by the Director of the United States Citizenship and Immigration Service as having a United States Government Affiliation and be conferred with the Status of Special Asylum or Special Refugee with United States Government Affiliations, provided –

(A) Such Foreign National has provided evidence that is satisfactory to the Director of the United States Citizenship and Immigration Service that establishes that the Foreign National thereof –

(1) Was employed by, on behalf of, or otherwise assisted the United States Government, and such service with and/or assistance to the United States Government, was honorable, faithful, meritorious, valuable, or any descriptors similar thereto, and/or has made a contribution to the National Security or other National Interests of the United States Government and;

(2) Has experienced or is reasonably expected to experience a threat of harm against their person or property, or otherwise has a credible fear of retribution or persecution, resulting as a consequence of their service with and/or assistance to the United States Government.

(B) Such Foreign National has undergone a favorable background investigation and it was determined that such Foreign National thereof -

(1) Has been found to be admissible to the United States in the capacity of a Refugee or to remain in the United States via Asylum, or has obtained a waiver of such inadmissibility or removability from the Director of the United States Citizenship and Immigration Service, and is eligible to receive an immigration visa, or has obtained a waiver of such ineligibility from the United States Secretary of State, and;

(2) The conferral of the Status of a Special Refugee or a Grant of Special Asylum for Foreign Nationals with United States Government Affiliations thereof would not otherwise be contrary to the best interests of the United States Government.

2. Any Foreign National with United States Government Affiliations that has been conferred with the Status of Special Asylum or Special Refugee with United States Government Affiliations by the Director of the United States Citizenship and Immigration Service shall be admitted into the United States as a Permanent Resident Alien, or if already within the United States, such current status shall be adjusted as appropriate, and shall be eligible for Constructive Credit for Residency towards United States Citizenship.

3. Derivatives – Foreign Nationals who has been provided Special Asylum or Special Refugee with United States Government Affiliations Status pursuant to this Section, shall have such status thereof extended to their Spouse(s) and Children, and in the discretion of the Director of the United States Citizenship and Immigration Service, such status may be extended to the Foreign Nationals Extended Family Members.

4. Numerical Limitations – Foreign Nationals who have been provided Special Asylum or Special Refugee Status pursuant to this Section shall not count against any numerical limitation as otherwise provided in the Immigration and Nationality Act.

5. Financial Sponsorship – Foreign Nationals who have been provided Special Asylum or Special Refugee Status pursuant to this Section shall not be required to have a financial sponsor.

SECTION 8

SPECIAL APPLICATION AND PROCESSING AUTHORITY FOR REFUGEE OR ASYLUM STATUS INVOLVING FOREIGN NATIONALS WITH UNITED STATES GOVERNMENT AFFILIATIONS

1. Any Foreign National who is not otherwise qualified for recognition as a Special Immigrant or eligible for the Status of Special Asylum or Special Refugee for Foreign Nationals with United States Government Affiliations, may nonetheless be recognized by the Director of the United States Citizenship and Immigration Service as having a United States Government Affiliation and be conferred with the Status of Asylum or Refugee with United States Government Affiliations under the same terms and conditions of Asylum or Refugees as set forth in the Immigration and Nationality Act, provided –

(A) Such Foreign National has provided evidence that is satisfactory to the Director of the United States Citizenship and Immigration Service that establishes that the Foreign National thereof –

(1) Was employed by, on behalf of, or otherwise assisted the United States Government and;

(2) Has experienced or is reasonably expected to experience a threat of harm against their person or property, or otherwise has a credible fear of retribution or persecution, resulting as a consequence of their service with and/or assistance to the United States Government.

(B) Such Foreign National has undergone a favorable background investigation and it was determined that such Foreign National thereof –

(1) Has been found to be admissible to the United States in the capacity of a Refugee or to remain in the United States via Asylum, or has obtained a waiver of such inadmissibility or removability from the Director of the United States Citizenship and Immigration Service, and is eligible to receive an immigration visa, or has obtained a waiver of such ineligibility from the United States Secretary of State, and;

(2) The conferral of the Status of Asylum or Refugee with United States Government Affiliations thereof would not otherwise be contrary to the best interests of the United States Government.

2. Any Foreign National with United States Government Affiliations that has been conferred with the Status of Asylum or Refugee with United States Government Affiliations pursuant to this Section, shall be admitted into or allowed to remain within the United States, as provided by the relevant provisions of the Immigration and Nationality Act, as it pertains to Refugees and Asylum, but shall otherwise be eligible for Constructive Credit towards Residency for an Adjustment of Status to Permanent Resident Alien and United States Citizenship.

3. Derivatives – Foreign Nationals who has been provided the status of Asylum or Refugee with United States Government Affiliations pursuant to this Section, shall have such status thereof extended to their Spouse(s) and Children, and in the discretion of the Director of the United States Citizenship and Immigration Service, such status may be extended to the Foreign Nationals Extended Family Members.

4. Numerical Limitations – Foreign Nationals who have been provided Refugee or Asylum Status pursuant to this Section shall count against any numerical limitation as otherwise provided in the Immigration and Nationality Act. However, Foreign Nationals who have been provided Refugee or Asylum Status pursuant to this Section shall be provided with preferential allocations of such numerical limitations as otherwise provided in the Immigration and Nationality Act as it is applicable to Asylum and Refugees.

5. Financial Sponsorship – Foreign Nationals who have been provided Special Refugee or Asylum Status pursuant to this Section shall not be required to have a financial sponsor.

SECTION 9

AUTHORIZATION TO EXPEDITE ELIGIBILITY FOR CITIZENSHIP AND ADJUSTMENT OF STATUS FOR FOREIGN NATIONALS WITH UNITED STATES GOVERNMENT AFFILIATIONS

1. Notwithstanding any other provision of law, the Director of the United States Citizenship and Immigration Service may grant any Foreign National with United States Government Affiliations with constructive credit towards satisfying the Residency Requirement towards United States Citizenship and/or Adjustment of Status to Permanent Resident Alien as herein provided –

(A) Any Foreign National with United States Government Affiliations who was harmed in the line of duty by any injury or disease, or as a consequence of their service with and/or assistance to the United States Government, has become completely debilitated or is otherwise disabled to such a degree that he/she is incapable of providing for their own activities of daily living, may be credited with satisfying any residency requirements towards United States Citizenship and be conferred with United States Citizenship upon the submission of a Petition for Naturalization by such Foreign National with United States Government Affiliations or their Representative thereof.

(B) Any Foreign National with United States Government Affiliations who was harmed in the line of duty by any injury or disease, or as a consequence of their service with and/or assistance to the United States Government, and has suffered any disability as a result of such injury or disease thereof, may be credited with an equal percentage of credit toward the satisfaction of residency for every percentage of a disability rating conferred thereon.

(C) Any Foreign National with United States Government Affiliations who has provided evidence that is satisfactory to the Director of the United States Citizenship and Immigration Service that establishes that such Foreign National’s service with and/or assistance to the United States Government was honorable, faithful, meritorious, and valuable, or any descriptors similar thereto, may be credited with one day of residency for every day of qualified service and/or assistance thereof.

(D) Any Foreign National with United States Government Affiliations who has provided evidence that is satisfactory to the Director of the United States Citizenship and Immigration Service that establishes that such Foreign National’s service with and/or assistance to the United States Government was performed under conditions that would have otherwise qualified such person for imminent danger, hostile duty, hazardous duty, or hardship duty compensation, or any equivalent thereof, may be credited with two days of residency for every day of qualified service and/or assistance thereof.

SECTION 10

PAROLE, TEMPORARY PROTECTED STATUS, AND CONVERSION OF STATUS

1. The Director of the United States Citizenship and Immigration Service shall authorize Parole or Temporary Protected Status as appropriate, and the Chief of Mission of the servicing Embassy thereof shall issue such travel documents and/or visa’s to any Foreign National with United States Government Affiliations, who is a Petitioner for the Status of a Special Immigrant, Special Asylum, Special Refugee, Asylum, Refugee, or any other Immigration or Withholding Application that is predicated upon the Petitioners or Applicants Status of being a Foreign National with United States Government Affiliations, provided –

(A) Such Petition or Application thereof has been submitted and any subsequent final adjudication and/or authorization to enter into or remain within the United States has exceeded one year from the submission date thereof, and;

(B) There is no extraordinary reason why parole should not be authorized by the Director of the United States Citizenship and Immigration Service and/or such travel documents and/or visa’s should not be issued by the Chief of Mission thereof.

2. Provided that any such Foreign National with United States Government Affiliations has been admitted on Parole into the United States for authorized to remain in the United States pursuant to a grant of Temporary Protected Status, such cases thereof shall be converted as follows –

(A) Petitions for the Status of a Special Immigrant with United States Government Affiliations will continue to completion.

(B) Petitions for the Status of Special Refugee and Refugee with United States Government Affiliations shall be converted into Petitions for Special Asylum and Asylum with United States Government Affiliations respectively, and such cases thereof shall be finally adjudicated in the United States Immigration Court in which District the Petitioner has resettled therein.

SECTION 11

PROTECTION OF FOREIGN NATIONALS
WITH
UNITED STATES GOVERNMENT AFFILIATIONS

1. The President of the United States in consultation with the Heads of all the other relevant Federal Departments and Agencies, shall make a reasonable effort to provide any Foreign National with United States Government Affiliations, and their eligible Family Members, with protection, and where indicated, immediate removal from any location of hostility and instability and relocation to any place of security and safety. In this regard –

(A) The President of the United States, the Head of any Executive Department or Agency, or any official from such Executive Department or Agency that occupies any position or status greater than or equal to a General Officer of the Military Services or a Member of the Civilian Senior Executive Service, or any other official who has been delegation such responsibility, may authorize the evacuation of any such Foreign National and their eligible Family Members to the United States or any other location that is suitable for ensuring the security and safety of such Foreign National with United States Government Affiliations and their eligible Family Members. In furtherance of this provision, any such evacuation or relocation of a Foreign National with United States Government Affiliations and/or their eligible Family Members may utilize United States Government assets and/or may be effected at the cost of the United States Government.

(B) The Attorney General or any other official delegated with such responsibility thereof, may authorize the enrollment of any Foreign National with United States Government Affiliations, into the Witness Protection Program, or any Program similar thereto, if in the opinion of the Attorney General or any other official delegated with such responsibility thereof, finds that a credible threat to the security and safety of such Foreign National with United States Government Affiliations and/or their eligible Family Members exists that warrants the extraordinary protections of the Witness Protection Program, or any Program similar thereto.

(C) Nothing herein shall be construed as limiting any other protective measure from which the United States Government may extend such protective services or benefits to such Foreign National with United States Government Affiliations and/or their eligible Family Members.

SECTION 12

FEES AND COSTS

The United States Government shall not assess any fee or cost in connection with any Petition or Application for Recognition or Benefits provided in this Act thereof.

SECTION 12

RESETTLEMENT SUPPORT

Any Foreign National with United States Government Affiliations who has been conferred with the Status of a Special Immigrant, Special Asylum, Special Refugee, Asylum, Refugee, or any other Immigration or Withholding Status, such as Parole or Temporary Protected Status, shall be eligible for resettlement assistance, entitlement programs, or other benefits available to Asylum or Refugees as set forth in the Immigration and Nationality Act.

SECTION 13

MISCELLANEOUS PROVISIONS

1. Section 1059 of the National Defense Authorization Act is hereby amended as follows –

(A) The Provision of such Act prescribing a Numerical Limitation of 50 Special Immigrant Visa’s per fiscal year thereof, is amended by striking such provision, and inserting “the Secretary of Homeland Security and the Secretary of State may confer the Status of a Special Immigrant upon, and issue such Special Immigrant Visa to, any Iraqi or Afghan National who has meet the requirements of this Act.

2. Section 1244 of the National Defense Authorization Act of 2008 is hereby amended as follows –

(A) Notwithstanding any other provision of this Act, the Secretary of State and the Secretary of Homeland Security, may continue to accept Applications for the Status of a Special Immigrant as provided in such Act, and to issue Special Immigrant Visa’s, and the Numerical Limitations of such Act, shall as authorized by the President of the United States, continue to carry forward from year to year, until such requirement for such program has abated, or all 25,000 Special Immigrant Visa’s have been issued thereof, whichever comes first.

3. Section 602 of the Omnibus Appropriations Act of 2009 is hereby amended as follows –

(A) Notwithstanding any other provision of this Act, the Secretary of State and the Secretary of Homeland Security, may continue to accept Applications for the Status of a Special Immigrant as provided in such Act, and to issue Special Immigrant Visa’s, and the Numerical Limitations of such Act, shall as authorized by the President of the United States, continue to carry forward from year to year, until such requirement for such program has abated, or all 7,500 Special Immigrant Visa’s have been issued thereof, whichever comes first.

4. The Director of the United States Citizenship and Immigration Service shall authorize Parole, and the Chief of Mission of the servicing Embassy thereof, shall issue such travel documents and/or visa’s to any Iraqi or Afghan National who has been awarded a General Officer or Chief of Mission Letter of Recommendation pursuant to Section 1059 of the National Defense Authorization Act of 2006, or to any Iraqi National who has been awarded a Chief of Mission Letter of Recommendation pursuant to Section 1244 of the National Defense Act of 2008, or any Afghan National who has been awarded a Chief of Mission Letter of Recommendation pursuant to Section 602 of the Omnibus Appropriations Act of 2009, provided –

(A) Such Petition or Application thereof has been submitted and any subsequent final adjudication and/or authorization to enter into the United States has exceeded one year from the submission date thereof, and;

(B) There is no extraordinary reason why parole should not be authorized by the Director of the United States Citizenship and Immigration Service and/or such travel documents and/or visa’s should not be issued by the Chief of Mission thereof.

5. Provided that any such Iraqi or Afghan National as described in Section 13(4) of this Act has been admitted on Parole into the United States, such cases thereof shall be converted into a Petition for Asylum, and such cases thereof shall be finally adjudicated in the United States Immigration Court in which District the Petitioner has resettled therein, and upon such adjudication, such Iraqi or Afghan National thereof, shall immediately have their Status Adjusted to Permanent Resident Alien, and shall be given constructive credit as provided in Section 9 of this Act.

6. Any Iraqi or Afghan National who has applied for the Status of a Special Immigrant pursuant to Section 1244 of the National Defense Authorization Act of 2008, or Section 602 of the Omnibus Appropriations Act of 2009, and such Chief of Mission Letter of Recommendation was denied or revoked, shall be entitled to have their case reopened, and such denial or revocation thereof, shall be reviewed de novo by the Chief of Mission or Chief of Mission Designee thereof, and any subsequent denials or revocations thereof, such shall be administratively reviewed by the Secretary of State or the Secretary of State Designee thereof.

First I want to say Ramadan Mubarak to all of our Brothers and Sisters. Second, Inshalla i will resume my posts in the next few days. I have been away on a campaign to get Congressional Support for our Proposed Law. I have been getting very good responses from everyone I talked to, but as all things political in the USA, its going slower than I would like. Good news is that there will be a one year extention to the SIV Program for Afghanistan and Iraq in the 2014 Defense Appropriations Act. So that gives me a warm and fuzzy feeling to get back to posting SIV Program information rather than switching my efforts to Refugee and Asylum Packets. But the long term solution to the problem with the SIV Program is not to keep extending a broken system, but to replace it with a real system. For that reason, we must actively get the word out to everyone to contact Congress and tell them to Sponsor, Co-Sponsor, and Vote for the enactment of the Law/Bill proposed by the Allied Freedom Project. OK, I have lots of emails to write, so inshalla I will see you very soon with our discussions on Immigration and Resettlement...

Today we are going to begin our discussions again on how to prepare, review, and submit an SIV Application Packet. This discussion series can equally be used to review an already submitted SIV Application Packet for Administrative Errors. The reason that we are going to begin this series of discussions at zero is because (1) I am confident that at an absolute minimum Congress is going to extend the SIV Program for one year, (2) I am now Posting for both Afghanistan and Iraq, and (3) because I have been seeing many of the same errors over and over again for the past 3 months since I’ve been posting and reviewing SIV Application Packets per requests from the participants on the Afghan/Iraqi SIV Applicants Association Facebook Webpages.

Some of the common errors that I have been seeing are what is called in the military “low hanging fruit”. Meaning simple and easily overlooked errors that nonetheless can and will have a major impact on the processing of your SIV Application Packets and the much despised Additional Administrative Processing. These errors include, but are not limited to (1) Name Discrepancies, (2) Date of Birth Discrepancies, and (3) Inconsistent Information being entered in the SIV Application Packet, I-360, DS-260/DS-230, and so on and so forth. So let’s fix these problem(s) in one of two ways…

The First Way is to prevent the problem in the First Place… The Second Way is to identify any Administrative Problems and then Correct them by notifying the Embassy of those errors and either providing them with the correct information (ie. an Amended/Corrected Document) or an explanation as to (A) what the error is, (B) what the correct information is, -OR- (C) an explanation of what the error is and why it cannot be reasonably corrected…

Now in order to do either of those two things you need to gather and organize your information and documents. Do this in these steps:

Gather every single document that you have or can reasonably obtain. These documents should include, but are not limited to (1) Passport, (2) Taskera/Jensia, (3) Birth Certificates, and yes I know not everyone has these, especially Afghanistan, (4) Awards, Certificates, Letters of Recommendation, (5) Educational Diploma, Certificates, Transcripts of Classes and Grades (Marks), (6) Health Records and Reports, (7) Employee Records, (8) USG Intelligence Reports on yourself if you can get them, you can ask, all they can say is “NO”, (9) ANYTHING ELSE that has your name on it…

Next, fill out the Form SF-86 (Questionnaire for National Security Positions). This is a very large form that asks for just about everything in your life, but the USG is going to ask you for this information sooner or latter in the SIV Process or when you get to the USA and you want a job with the USG working as a Linguist and Cultural Advisor or any other employment position that requires a Security Clearance.

Now in doing both of these steps, the goal is to ensure that your INFORMATION and DOCUMENTS are exactly the same. Everything should be the same… key words to stress my point: Everything must be Exactly the Same… if your name is “Mohammad Afghan Iraqi Khan”, then your Passport, Taskera/Jensia, LN Employee Badge, and all your Immigration and Resettlement Documents and Forms needs to say “Mohammad Afghan Iraqi Khan”… The same concept applies to your Date of Birth, Place of Birth, Parents Names, and so on and so forth… Use the SF-86 is your worksheet to consolidate and organize your information… From there you will then use that information to prepare your SIV Application Packet and subsequent Immigration and Resettlement Documents and Forms…

Now if you have already submitted your SIV Application Packet and/or Immigration and Resettlement Documents and Forms, then look at your stuff very carefully and if you find any error, no matter how small, then you need to send the Embassy an Email that states what the error was, where the error was, and what the correct information is… so for example, let’s say that “Mohammad Afghan Iraqi Khan” wrote in the DS-157 (Supplemental Non-Immigrant Visa Form) that his name was “Mohammad Iraqi Khan” and in the I-360 he wrote that his name was “Mohammad Afghan Khan”… well that is a major name discrepancy. So the way to fix that is to notify the Embassy of the error and to state that “Mohammad Iraqi Khan” and “Mohammad Afghan Khan” are one and the same person and that the true full name is “Mohammad Afghan Iraqi Khan” and to prove as much, you should show the Identification Document that states the true full name, such as the Passport or Taskera/Jensia. But if all your documentation is the same, then you should use the name that matches your Documentation. But what if the Identification Documents are different, well then, simple answer, get your Identification Documents changed so that they all are exactly the same. I know this is easier said than done, but considering this may be what gets your Visa Approved or Denied, you seem to have no other choice than to make it happen, even if that means paying corruption. But let’s say it is now impossible to get your documentation corrected, then the best you can do is to notify the Embassy of the Error and provide them with an explanation of what the correct information is and why you cannot correct it…

OK, so in conclusion, collect all your documents and organize all your information by using the SF-86 as a tool… Next Post we will discuss the SIV Application Packet…

POST BY RONALD PAYNE – In my last Post we talked about collecting and organizing your information and documents. I recommended using the Form SF-86 (Questionnaire for National Security Positions) as a tool to collect and organize your information and documents. Sufficient time has passed from my last Post (I’ve been very busy with other endeavors) so I am assuming that many of our members here have downloaded the SF-86 and completed its preparation by now. Now unless you are planning on joining the United States Military or becoming employed with the United States Government at a latter time, this form is only a “worksheet”, but much of the information contained within this Form will be asked of you latter in the Immigration and Resettlement process. So let’s begin…

In both Iraq and Afghanistan the Passport is you most important document because it proves both Identity and Citizenship. This is also the first document that your identifying information will be compared against all of your other information and documents. Thus this is the most important document to have the correct information listed therein. The Second most important document is the Afghanistan Taskera (which is BOTH a National Identification Document AND a Birth Certificate) or the Iraqi Jensia and Birth Certificate. Your information on these documents must be accurate and match the Passport, and just as important, their English Translations must also be accurate and match the English portion of the Passport. After names, then the (1) Date of Birth and (2) Place of Birth must match. Parents names should also be checked and be a match on both documents as applicable. After these documents the Name and Date of Birth should also match the Local National Employee Badges. After that, a check should be done to ensure that all of your other information is also exact, meaning, if your name is “Mohammad Afghan Iraqi” then that should be the name on your (1) Passport, (2) Jensia/Taskera, and as it is listed on all of your SIV Application Packet and on all of your Immigration/Resettlement Applications and Forms. The key to everything is that all of your information should be the same on every document and in every SIV Application Packet and every Immigration/Resettlement Application or Form.

So that leads into the second part of this discussion, what if the information is incorrect or there is a discrepancy. The answer to that problem depends on what stage of the process you are in… Obviously I would prefer that the stage of processing would be Pre-Submission. So we will start there. If you have NOT yet submitted (or re-submitted) a SIV Application Packet, then I would advise you to get all of your documents corrected (even if it means paying corruption). Now if that is not possible, then you will need to prepare your Bio-Data Sheet with the CORRECT Information and then prepare a Statement that explains what in your Documents is incorrect and sets forth what the correct information is. Now in the case of a name discrepancy, that statement could be corroborated by a “One and the Same Person Memorandum” that is written by a US Citizen Supervisor. So for example, lets say that you name is “Mohammad Afghan Iraqi” and that is what your Passport says… but your Taskera/Jensia says your name is “Mohammed Afghan” (do you see the first and second errors?) and your LN Bade says that your name is “Mohammad Iraqi” (do you see the error?), and lets say that your true Date of Birth is 12 June 1985 and that is listed in your Jensia/Taskera, but your Passport and LN Bade says that your Date of Birth is 01 January 1985 (do you see the errors?)… A fix to this would be to get a new Passport and Taskera/Jensia, but that may not be possible, so you would have your US Citizen Supervisor make a copy of all there documents and write a memorandum that say that he was your US Citizen Supervisor and personally knows you, and that you and all of your documents are “one and the same person”, and you would attach his/her memorandum to your “Statement of Explanation of Errors and Discrepancies”… Now in the case where you have already submitted your SIV Application Packet and/or other Immigration/Resettlement Applications and Forms, you may want to consider getting your documents corrected to show the accurate information and to then submit an amendment and explanation of any such errors and discrepancies that you found. Your Statement should include what Application or Form contained the error or discrepancy, its page number and block or box number if applicable, what the error or discrepancy was , and what the correct information is, and if possible, the evidence that you have to support what you are submitting.

In conclusion, it is essential that all of your information is correct and consistent throughout your entire SIV Application packet and throughout all of your Immigration and Resettlement Applications and Forms, and that your information and supporting documentation (ie. Passport, Jensia/Taskera, LN Badge, Awards, Certificates, LOR’s, so on and so forth) match your information (or you can explain the error, inconsistency, or discrepancy easily). When I conduct a review of a SIV Case, this is what I am looking for, I am looking for Administrative Errors, this is what can be prevented, or what can be corrected after submission… Now stuff involving derogatory information, that is beyond either of our control, but if you know you have derogatory information, then submitting an explanation may help (you have nothing to lose by trying)… If you follow my directions exactly, 90% of the cases can be reviewed by yourself, but if you want me to conduct a review, then naturally the accuracy of my review will depend on the extent of the record available for review, and what I would require at a minimum (or what you should look at as a minimum) is the (1) SIV Application Packet, (2) COM LOR or Denial Notice, (3) I-360, (4) DS-230 or DS-260, (5) DS-157, (6) DS-234, and (7) all of the documents submitted with any of these forms (ie. Passport, taskera/Jensia, so on and so forth)… Finally, where there is an error or discrepancy, fix it or explain it…

POST BY RONALD PAYNE – Today’s topic of discussion will be Immediate, Short-Term, and Long-Term Housing. In discussing this subject I am making the following assumptions. (1) The SIV is either Married and has Children (wife and 2 children) or is Single with no Children, (2) That both SIV’s has more than $5000 but less than $10000, (3) that the SIV is traveling to the USA on their own (because this issue would not apply to a SIV that traveled via IOM because IOM and the Refugee Resettlement Agency (RRA) would have already arraigned for the SIV’s Housing)., and (4) the SIV is completely on their own, meaning that they have absolutely no Sponsor, Family, or Friends to help them in any way. As a disclaimer, I am using San Antonio as the example for this discussion, however, the concept will be the same in just about every other location in the USA that has a Refugee Resettlement Agency.

Let’s begin at the Airport since that will be the actual beginning point of this discussion. Your first step is to travel from the Airport to a Hotel/Motel. This will be effected by taking a taxi. Now you should also know that Taxi’s in the USA are very expensive (they charge on average about $2.50 just to get in the taxi, and then about $3.00 for each mile traveled).

SIDE NOTE: There are two kinds of hotel/motel’s in San Antonio (and other major cities). These would be (1) short-stay, and (2) extended-stay hotel/motels. Short-Stay Hotels/Motels basically consist of a room with the facilities to sleep (ie. bed) and to perform bodily functions and personal hygiene (ie. toilet and shower/bathtub). The key here is to identify that in a Short-Stay Hotel/Motel there is to facilities for the preparation of food (ie. no kitchen or cooking capabilities). The average cost of a Short-Stay Hotel/Motel is about $75 per night. An Extended-Stay Hotel/Motel is equipped with the same facilities of a Short-Stay Hotel/Motel, but it also contains facilities for food preparation (ie. Stove, oven, microwave, refrigerator, sink, you get the idea). Extended-Stay Hotels/Motels are usually rented by the week and month. When rented by the month the cost can be about 25% less expensive than if it was to be rented by the week. The average cost of an Extended-Stay Hotel/Motel is about $300 per week. Now the average SIV takes approximately one week to find and rent an apartment, but I always say to think conservatively and plan to be in a Hotel/Motel for the first two weeks of arrival in the USA. So do some math, in a Short-Stay Hotel/Motel that costs about $75 per night, for 14 nights, then you should expect to pay about $1000… While if you stayed for 2 weeks in an Extended-Stay Hotel/Motel it would cost you about $650… Now there is one more thing to think about, and that would be the cost of food. If you stayed in a Short-Stay Hotel/Motel then you would realistically be getting most of your food at a restaurant and the average meal will cost you about $15 per meal. So assuming that you ate twice per day, that would cost you $30 per day, times 14 days, that would cost you about $500. So adding the cost of the Hotel/Motel and Food, that is a grand expense of about $1500 for the first two weeks… on the other hand, by temporarily residing in an Extended-Stay Hotel/Motel you could buy regular groceries and cook “at home” for easily half the cost of eating in restaurants, which by comparison would cost the Extended-Stay SIV about $800 for the same period of time. In short, I would highly recommend that anyone that is going to be staying in a Hotel/Motel for longer than a few days, should stay in an Extended-Stay Hotel/Motel…

So back to the main point of this discussion… For the purpose of this discussion we will assume that the SIV has elected to stay at an Extended-Stay Hotel/Motel, and the place that was chosen was “Budget Suites of America” which is located at 7880 Fredericksburg Road, San Antonio, Texas 78240 (DISCLAIMER: I am only mentioning this specific Extended-Stay Hotel/Motel because it has become a regular destination in San Antonio for First Time and Returning SIV’s and these SIV’s reported to be that their experience in this place has been favorable).

Using the taxi Trip Cost Estimator on the Yellow Cab Taxi Service Website (http://www.yellowcabsanantonio.com/Fare_info.aspx) the distance between the Airport and the Hotel/Motel is 7.5 miles, it will take 14 minutes to make the journey, and the estimated fare will cost $24 dollars.

You checked into the Hotel/Motel and paid for one week’s rent ($300). You then went out to a restaurant within walking distance and got something to eat (Married $75, Single $20) and went back to your Hotel/Motel and went to sleep. Life sucks for you and you follow my advice and wake up at 4am and everyone feels sick and tired, but you get up anyways, perform personal hygiene, get dressed, and call a taxi at 5am. You then take you (and your family as applicable) with your passports/visas and travel to the Social Security Office that is located at 411 Richland Hills Road, San Antonio, Texas 78245. You get there between 5:30 and 5:45am and you are the only one there. You are getting pissed off at me right about now because it is dark, cold, windy, and you’re the only one standing in a non-existent line, and the taxi cost you $25 dollars. At about 6am the second person shows up, and about every minute after that 2 to 5 people show up and start getting in line, and by 7am the line is about 100 people long and is wrapped around the building. Then it registers in your mind, “now I understand why Ronald Payne told me to come at this time”… yeah, because the Social Security Office opens at 8am and if you show up anytime after 6:30am to get in line, you will be waiting all day (like in at least 4 to 6 hours) before you are even seen (at it will be one miserable experience to sit in a Social Security Office Waiting-Room for any real length of time). But you were the very first in line and waited for 90 minutes, but in under 45 minutes of the door opening, you were in and out. Now your purpose of going to the Social Security Office was to apply for a Social Security Card/Number, and you need the Receipt that you applied for it BEFORE you can apply for and receive your ORR Resettlement Benefits.

So you then take another taxi from the Social Security Office to Catholic Charities Refugee Services which is located at 202 West French Place, San Antonio, Texas 78212 and your taxi cost you about $10 dollars. You then get seen by a Case Manager and apply for your ORR Benefits. This process takes you about 2 hours to complete. By this time you are getting very sick and tired so you decide to call it a day and go back to your Hotel/Motel to get something to eat and to get some sleep. You call a taxi and the taxi ride costs you about $20 dollars.

OK, so minus some other things that you will be required to take care of during the next week, you now begin your search for an apartment. You started this search by asking for a housing referral from your case Manager at Catholic Charities refugee Services. You are told about a couple of Apartment Complexes that Catholic Charities Refugee Services has a contact with. Some are better than others, and each has their positive and negative points of consideration, and you have resigned yourself to accepting that you will be living in a piece of shit place for the first 6 months. So you pick the worst place of them all, and for the Single SIV you picked “Fairways V Apartment Complex” (http://www.fairways5.com/) which is going to cost you about $550 per month for a studio/efficiency or about $650 for a one-bedroom apartment. But that is not the total cost, they are also going to charge you about $30 per month for cable television and between $30 to $50 per month for electricity and gas. So your real cost is going to be between $600 and $700 per month. But cut that in half if you have a room-mate (ie. another SIV) hint hint hint… Now the married SIV sunk even lower and rented a place at “Dove-Tree Apartment Complex” which is located at 4515 Gardendale Street, San Antonio, Texas 78240 where they got a two bedroom apartment and are being over-charged at about $800 to $850 per month, not including electricity and gas which will cost you on average of about $100 to $250 per month. You take the deal even though you know that this place is stealing the money right out of your pocket. But you thankfully only signed a 6 month lease.

Now other options are out there in your search for apartments in San Antonio, and now assuming that you took your time to do your research and made some phone calls before you went out to check a place out (because each trip in a taxi is costing you a lot of money)… hint hint hint, what you really did was do your research while you were still in Iraq or Afghanistan… and what you did was to search some of the more popular apartment search websites, such as:

http://www.apartmentlistings.com/

http://www.forrent.com/

http://www.apartmentguide.com/

and of course you could conduct an open internet search in Google or Yahoo under “[name any city] apartments for rent”… or for example “San Antonio Apartments for Rent”…

Now, sometimes there are some good deals on a website called “craigslist”, but I would strongly suggest that you stay away from this website until you been in the USA for awhile, because this website is full of scams and frauds, and the scammers and fraudsters using this website are very good at perpetrating their crimes and you don’t have enough money to be scammed or defrauded during your resettlement…

OK, so you did your research and you found a place that you want to move into. So your next step is to go to the Apartment Complex Leasing/Rental Office and to apply for an Apartment Lease or Rent. So let’s stop here for a moment, what is a Lease and what is Rent (ie. Month to Month Rent)… A LEASE is a contractual agreement where the Apartment Complex agrees to rent you an Apartment for the term of the contractual agreement, AND you agree that you will rent the Apartment for the term of the contractual agreement. Most Apartment Complexes in the USA will only rent an Apartment via the Lease Option, and most Leases are either 6 Months, 12 Months, and sometimes 18 to 24 Months. Most Leases are 6 or 12 Months. Now what that means is that if you lease an apartment for 6 or 12 months, the good part is the monthly rent will stay the same for the entire contract period of time. The bad part is that if you want to leave early, you are in a contract and they can make you pay for the apartment for the rest of the contract period of time, or most apartment complexes will have a “Lease Break” Provision in the lease Contract that will allow you to “break the lease” if you pay a fee, and that fee is usually the cost of one month’s rent. The other part of a lease is that at the end of the lease, if the person wanted to stay there, the price of rent could go up with the next lease contract period of time. Now the other option is a “Month-to-Month” rental agreement. This option is rare with most apartment complexes, but it does exist. In this option, the person pays the rent every month, they can leave at the end of any month and they have nothing extra to pay if they so choose to leave. On the other side, if the owner or manager of the apartment complex does not like you, then they can choose to tell you to leave, and on a month-to-month rental agreement, if that is the case, you got to go, and your in deep shit trouble of your don’t have another place to go to…

So at this point you filled out your Apartment lease/Rental Agreement and you have “No Credit” (we will talk about this in another post) because you are new to the USA. And I am also assuming that at this time, you have no income except your ORR benefits, which will add up for their purposes to about $450 per person, so if you have a family of 4, that would be $1800 per month. But if your single, $450 is not much. So they tell you that you either (1) have to pay everything for the full lease period up front, which if you have a $800 per month apartment, will cost you $4800 for a 6 month lease, or (2) you have to pay FIRST-LAST-SECURITY DEPOSIT… Now sometimes, you will manage to rent an apartment without these costs, but for planning purposes, you should assume that every place you go to will want to charge you the FIRST-LAST-SECURITY DEPOSIT…

So what is a FIRST-LAST-SECURITY DEPOSIT?... well that would be an up-front payment of the First Month Rent, the Last Month Rent, and a Security Deposit that is usually equal to the cost of one month’s rent. So for example, a $800 per month apartment with a 6 month lease would cost you $1600 in up-front rent for month 1 and month 6, and $800 in a “Security Deposit”… Now the person would be responsible to pay the rent for Month’s 2, 3, 4, and 5… if they were leaving, then month 6 is already paid, and of they were staying, they would pay for month 6 and the “last” would carry forward until the final month that they would live there until they left. Now the “Security Deposit” is money that is given to the Apartment Complex to pay for any damages to the apartment that was caused by the renter. Theoretically if there are no damages and only normal wear and tear of the apartment, then the money is supposed to be returned when the person moves out. But historically, there is always claimed damages above normal wear and tear and only part of the security deposit is returned when the person moves out. The key to getting the most back is to fully inspect the apartment when moving in and recording any pre-existing damages and ideally taking pictures of this, and then recording the condition of the apartment when leaving, and ideally by photograph or video, and that way if the owner or manager of the apartment complex says there is anything that is not true, you can say (and show) that you have pictures or video to prove otherwise, and then “we can let the court decide” what is true or not true. Usually that is enough to get your money back. But if you actually damage the place, then rightfully it should be expected that whatever it cost to fix the damage will be taken out of the security deposit. So in short, at an absolute minimum, you should plan that it will cost you three times the amount of the monthly rent to lease/rent an apartment, and in the case of a $800 per month apartment, that estimated cost for planning purposes should be no less than $250o (which includes the apartment application fee)… Now on that note, almost all apartment complexes will charge you a small application fee (about $15 to 25) and this will include the fee to run a credit report on you (we will talk about credit reports and credit scores in another post).

The last thing is the cost of utilities (ie. Electricity and gas). Some apartment complexes will manage those services and add the cost of those services to your monthly rent, and for those that do not, the apartment complex will provide you with the contact information of those who do…

Now one very last thing, there are some apartment complexes that are all inclusive, meaning that the cost of utilities and everything is included in the rent. For a single person who really wants to live alone, and is ok with a small place, there is an apartment complex in san Antonio called “Warren House” (http://www.warrenproperties.com/index.php?option=com_properties&view=locality&lid=41&Itemid=76) that have apartments that are fully furnished and includes all utilities and cost between $450 to $500 per month. There are several SIV’s who are living there and I have not heard any complaints from them, and the cost of moving in there is much less expensive than renting a traditional apartment. Now for the very very last thing that I have to say… Married people and Families obviously are going to stay in their own place, but for Single People, I recommend that they get room-mates, and the most cheapest way to do this is to have 2 people per bedroom, so if 4 SIV’s rented a 2 bedroom apartment, and that apartment cost $800 per month, simple math would say that the per person cost is $200 per month. Hint hint hint… If your ORR rental Benefit is $245 per month, and 4 SIV’s shared a 2 bedroom apartment, then that $245 ORR Rental Benefit would easily pay for the Rent and Utilities, this is the standard of housing standards from which that ORR Benefit amount was determined. Likewise, take a married person with 2 kids, and the ORR housing Benefit is $245 per-person, that would be a total of $980, of which if they stayed in a 2 bedroom apartment that cost $800 per month, then that would leave $180 per month to pay for utilities. Once again, see how that ORR Rental Benefit amount was set at $245 per-person per-month…

OK, that concludes today’ discussion, and although I used San Antonio as the example for this discussion, the concept is the same for just about every city in the United States. Until my next post, everyone stay safe

فلقد كتب العسكري رونالد بين التالي-ادناه- بشان الاوامر الجديده والتمديد الجديد الذي حصل التالي :-

POST BY RONALD PAYNE – Congress has passed and the President has enacted into Law the National Defense Authorization Act for the Fiscal Year 2014. I have conducted a thorough review of this law and this is my report to the SIV Community as to the relevant provisions of this Law, its benefits, its shortcomings, and what we are advocating to remedy its shortcomings.

This Law contains 493 Pages and over 4000 Sections. Two Sections pertain to the SIV Program, Section 1218 which applies to Iraq, and Section 1219 which applies to Afghanistan. Both of these Sections amend existing law as it pertains to the SIV Program, and specifically Section 1244 of the National Defense Authorization Act of 2008 (Iraq COM SIV Program) and the Afghan Allies Protection Act of 2009 (Afghanistan COM SIV Program). There has been NO change or amendment to Section 1059 of the national Defense Authorization Act of 2006 (AFG/IRQ Interpreter/Translator SIV Program, the General Officer and Chief of Mission SIV Program, the 50 SIV per Year SIV Program).

Both provisions of this law (1218 and 1219) provide for the appointment of a “Special Immigrant Visa Coordinator” for Iraq and Afghanistan (one each for AFG and IRQ) whom shall be given sufficiently high security clearance and who will be responsible for “overseeing the efficiency and integrity of the processing of special immigrant visas.

Both provisions of this law (1218 and 1219) require the Embassy to process a SIV Case to conclusion within 9 months “except in those high-risk cases for which the satisfaction of national security concerns requires additional time”. So this basically means that the Embassy will be required to issue the SIV Visa in 9 months or less unless a high index of suspicion exists to believe that the SIV Applicant poses a threat to the National Security of the United States.

Both provisions of this law (1218 and 1219) provide for an Administrative Review (Appeal) of a COM DENIAL (but it is silent on COM Revocations), although I would argue that it was the Intent of Congress to include and/or treat COM Revocations as a COM Denial. The specifics of this particular provision requires that and SIV Applicant who’s COM was Denied would be required to:

Request an Appeal of the COM Denial (and a request for the reason of such denial thereof), and of which then the SIV Applicant would be provided with a written decision that provides to the maximum extent feasible (which really means only the disclosure of unclassified information, so in reality, there will be no disclosure of any valuable Intelligence or Law Enforcement Information, Reports, or Records), the INFORMATION describing the basis for the Denial, including the facts and inference underlying the individual determination. Now I fully support this particular provision because it at least puts the person on notice as to the gist of the alleged reason for the COM Denial. This at least can be responded to with a presentation of Exculpatory, Extenuating, and/or Mitigating Evidence.

Now, what should also be mentioned is that is particular provision also states that only ONE Appeal will be provided, and that it must be submitted within 120 days after the applicant receives such decision in writing, of which the appellant may request the reopening of a case to present additional information. Now the statutory language does not state exactly what constitutes the “receives such decision in writing” from which this 120 day appeal submission is triggered. Because there could have been no such Appeal prior to the enactment of this law, it is my Legal Opinion that the burden to begin the process will be on the Applicant (Appellant) to submit a “Request for Administrative review of COM DENIAL” and a “Request for Disclosure of Information describing the basis for COM DENIAL”. After such Request(s) have been received by the applicable Embassy (SIV Committee) then the 120 appeal submission date will begin after the Information describing the basis of the COM DENIAL has been disclosed or otherwise provided to the SIV Applicant. Thereafter, within 120 days, the SIV Applicant will have to submit their Appeal and Evidence supporting their position that the COM should be Awarded. The Special Immigrant Visa Coordinator will then conduct his/her Administrative Review of the Case and make a Recommendation to the Chief of Mission to Award or Deny the COM SIV Application.

Now as it pertains to the Appeal, pay close attention to the part that the Appeal Itself needs to be submitted in under 120 days AND that there will only be ONE Appeal. So it’s a one-shot deal, so get it right the first time (and the one and only time to emphasize the point).

Another provision that is applicable to both Iraq and Afghanistan pertains to a provision that will provide that a credible sworn statement depicting dangerous country conditions, together with official evidence of such country conditions from the United States Government, should be considered as a factor in the determination of whether the alien has experienced or is experiencing an ongoing serious threat as a consequence of the alien’s employment by the United States Government. What this basically means is that the SIV Applicant will still have to demonstrate that they have been specifically threatened, but that the general security situation (dangerous) is also to be considered as a factor in assessing the SIV Applicants Threat Statement. I will devote an entire post to this subject later, but I will say this, this is a GREAT provision to take any otherwise WEAK Threat Statement and make it at least half-decent or Average Threat Statement, and an Average to a Great Threat Statement…

As this law pertains to Iraq, the SIV Program is extended indefinitely (meaning there is now NO fixed date that the SIV Program will expire), but that it will expire after 2500 Visa’s have been issued after 01 January 2014, but the BAD NEWS is that the law requires that the SIV Application Packet MUST be submitted BEFORE 30 September 2014. So what this means is that for those who are going to submit their first or their subsequent SIV Application Packet, this LAST SIV Application Packet had better be prepared absolutely correct in every regard. So what I’m trying to say is, you have 8 months easy left to submit it, take your time and get it absolutely correct before you submit it. Haste makes Waste…

As this law pertains to Afghanistan, there has been NO extension for your COM SIV Program, and your COM SIV Program is currently scheduled to expire on 30 September 2014. So what I have to say about that in this regard is the same thing that I would say to Iraq, take your time to submit your SIV Application Packet, get it right the first time (and possibly the last time if there will be a subsequent submission). You will get an Appeal just like Iraq, so that is the GOOD NEWS.

As to the Allied Freedom Project overall opinion of this Law. We think it was better than nothing, we feel comfortable with it only because it has the Appeal provision and a High Official who is tasked with making sure that everyone is actually doing their job and is not sitting on their ass and bull-shitting all day, as well as being able to review the cases that have or will be COM Denied to ascertain if the reason for such Denial was legitimate or bullshit. I suspect that things will soon be going the way they should now that the Embassy Staff will actually have someone watching them. As to the current expiration dates of the SIV Program, we think that this is unacceptable, and several members of Congress agree with us in that regard, and additional legislation will be introduced in Congress to continue to expand and extend the SIV Program to ensure that all those who supported the USG will not be abandoned. The Allied Freedom Project likewise is continuing to aggressively advocate the cause of the Afghan and Iraqi Local National who was employed by or on behalf of the United States Government through our efforts to create a Permanent Special Immigrant and Refugee Admissions Program for Foreign Nationals with United States Government Affiliations.

In conclusion, while I have more than a reasonable confidence that as each period of time passes, the shortcomings in the SIV Program will be rectified and corrected, but until then, we will proceed forward with the SIV Law that we have today. Today what we have available is an opportunity for all Afghans and Iraqis to submit a SIV Application Packet prior to 30 September 2014 and to have a fair Administrative Review if the COM is Denied. Iraq still has a United States Refugee Admissions Program for Iraqis with United States Government Affiliations, and we are confident that Congress will extend this to Afghanistan in this Legislative Session. Both Iraq and Afghanistan also have the ability to apply for Asylum if they can reach a United States Border and Port of Entry, and Afghanistan and Iraq can still apply for Refugee Status with the United Nations High Commissioner for Refugees (UNHCR) and make a compelling case to be third-country resettled in the United States based upon their United States Government Affiliations. We will look for positive option and decline to become demoralized because of any obstacles that may present. Nobody gets left behind…

Now as a special note, unlike my recommendations for Afghanistan as it applies to Appeals of COM Denials/Revocations, I have a different strategy for Iraq. It is my OPINION (key word is "opinion") that it may be better to resubmit a COM SIV Application Packet and then if that subsequent COM is Denied to Appeal that decision. Now on the other hand, if it has been denied two or more times, then I would suggest to utilize the Appeal Process if you absolutely have no clue why you have been denied and none of your own investigative endeavors has discovered a reasonable explanation for the previous COM Denials. Likewise, while the Iraqi and Afghan SIV Applicants are visiting each others SIV Applicant Association Pages, the advice and guidance that I am giving to each is going to be different in regards to the Appeal Strategy because the law is slightly different for each of you (honestly Iraq is getting preferential treatment when compared to Afghanistan, from which in all reality Afghanistan is getting royally screwed)...

واذا كانت حقيقية كيف التقديم لطلب الاستئناف وهل يوجد شخص قدم استئناف على ال SIV؟؟؟

تحية طيبة اخةتي الاعزاء انا عن تجربة شخصية لم يستطع الضابط رونالد تقديم اي مساعدة لي ليس انتقاص مني به ولكن هذا ما حدث معي وهناك عدةاشخاص لم يساعدنا وانا شخصيا راسلته عدة مرات ولم يجبني ولم اتلقى اي مساعدة فلا تضعوا املكم به الاعتماد على الله وبعد ان يأست ذهبت الى لبنان وانا حاليا هناك واتمنى التوفيق للجميع ويارب السفر العاجل للجميع تحياتي
